Terms of Service

Introduction

These OnCert Terms of Service (“Agreement”) govern your access to and use of OnCert’s service offerings (“Services”) and constitute a legally binding agreement between OnCert and you, or the entity you represent.

This Agreement becomes effective when you click an “I Agree” button, check a box presented with these terms, or otherwise access or use the Services. If you are entering into this Agreement on behalf of an entity, you represent and warrant that you have the legal authority to bind such entity.

By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by this Agreement, together with all policies and notices published on the OnCert Website.

Definitions

For the purposes of this Agreement:

• “Business Days” means Monday to Friday, excluding public holidays in Malaysia.
• “Business Hours” means 9:30 a.m. to 5:00 p.m. on any Business Day.
• “OnCert Website” refers to https://oncert.my or any successor website owned or operated by OnCert.
• “Services” means the web-based services provided by OnCert and/or its affiliates.
• “Service Fees” means the fees payable by the User to OnCert for the Services.
• “Credits” means prepaid units purchased by the User to access and utilise the Services.
• “User”, “you” or “your” means any individual or legal entity accessing or using the Services.

Use of the Services

3.1 Account Registration

To access the Services, you must register for an OnCert account using a valid email address and phone number. You are solely responsible for all activities conducted under your account, whether by you, your employees, or any third party authorised by you. You must keep your login credentials confidential at all times.

3.2 Unauthorised Access

OnCert shall not be responsible for any unauthorised access to your account. You must notify OnCert immediately if you suspect any unauthorised use or security breach relating to your account.

3.3 Service Provision

Unless expressly stated otherwise, OnCert does not provide or maintain any hardware, internet connection, or third-party software required to access the Services.

Service Fees and Payment

All Service Fees are denominated in Malaysian Ringgit (MYR). Payments must be made in full without set-off or deduction. Currently, payments are supported via Online Banking.

OnCert reserves the right to revise Service Fees at any time. Any changes will be communicated via email and/or published on the OnCert Website and shall take effect immediately or within the period specified.

Failure to settle outstanding payments after four (4) follow-up notices may result in late charges, suspension, or termination of your account.

Credits

Use of the Services requires the purchase of Credits. Credits will be deducted based on actual usage and remain valid until fully consumed. Once Credits are exhausted, access to the Services will be suspended until additional Credits are purchased.

Credits are non-refundable and non-transferable, except where required by applicable law.

Disclaimer and Limitation of Liability

The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, OnCert disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

OnCert does not warrant that the Services will be uninterrupted, secure, error-free, or that any results obtained will be accurate or reliable.

To the maximum extent permitted by law, OnCert shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages, including but not limited to loss of profits, data, goodwill, or business interruption, arising from or in connection with the use of the Services.

You agree to indemnify and hold harmless OnCert, its affiliates, directors, officers, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Services, breach of this Agreement, or violation of any applicable law or third-party rights.

Suspension and Termination

OnCert may suspend or terminate your account immediately if:

• Your use of the Services poses a security risk to OnCert or any third party;
• Your use may expose OnCert to legal or regulatory liability;
• You breach any provision of this Agreement; or
• You fail to pay Service Fees after four (4) follow-up notices.

Upon termination, you remain liable for all Service Fees incurred prior to termination. OnCert may permanently delete your content after termination, unless retention is required by law.

Privacy Policy and Data Protection

OnCert’s Privacy Policy forms an integral part of this Agreement. By using the Services, you consent to the collection, processing, and disclosure of your personal data in accordance with the Privacy Policy.

OnCert may verify your personal data with third parties where necessary for the provision of the Services. Continued use of the Services constitutes acceptance of any updated Privacy Policy.

Suggestions and Feedback

Any suggestions, feedback, or ideas submitted to OnCert shall become the sole property of OnCert. You hereby assign all rights, title, and interest in such submissions to OnCert, and OnCert may use them without restriction or compensation.

Changes to the Services

OnCert reserves the right to modify, suspend, discontinue, or deprecate any part of the Services at any time. Material changes will be communicated via email and/or published on the OnCert Website.
